Terms of Use

These Terms of Use ("Terms") govern your access to and use of cnbcreative.studio (the "Site"), operated by CNB Creative LLC, a Texas limited liability company ("CNB Creative," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

The Site is provided to share information about our video and photo production services and to let you contact us. You may view and use the Site for your own informational and business purposes, subject to these Terms.

2. Our work and intellectual property

The Site and its contents, including videos, photographs, text, graphics, logos, and design, are owned by CNB Creative or by our clients and licensors, and are protected by copyright, trademark, and other laws. Portfolio work is displayed with permission from the clients we produced it for. Client names, logos, and trademarks belong to their respective owners, and their appearance on the Site does not imply any endorsement beyond the testimonials those clients provided.

3. What you may not do

When using the Site, you agree not to:

• Copy, download, reproduce, distribute, modify, or publicly display Site content, including videos and photographs, without our written permission
• Use Site content, in whole or in part, to train, develop, or improve artificial intelligence or machine learning models
• Use automated tools to scrape, crawl, or harvest content or information from the Site
• Frame or mirror the Site, or present our work as your own
• Interfere with the security or operation of the Site, or attempt to gain unauthorized access to it
• Use the Site for any unlawful, fraudulent, or harmful purpose

4. Inquiries, quotes, and services

Information on the Site about our services is general and may change at any time. Submitting an inquiry does not create a client relationship or obligate either of us to anything. Quotes and proposals are estimates until both parties sign a written agreement, and any production we perform is governed by that agreement. If the agreement and these Terms conflict, the agreement controls.

5. Information you submit

When you contact us through the Site, you agree to provide accurate information and to share only information you have the right to share. Our use of that information is described in our Privacy Policy.

6. Testimonials and results

Testimonials on the Site reflect the real experiences of individual clients. Every project is different, and those experiences are not a guarantee of any particular result.

7. Third-party links and content

The Site may contain links to third-party websites or content embedded from third-party platforms, such as Vimeo and HoneyBook. We do not control and are not responsible for third-party content, services, or privacy practices. Your use of third-party sites and services is at your own risk and subject to their terms.

8. Copyright concerns

We respect the intellectual property of others. If you believe content on the Site infringes your copyright, send us a notice that identifies the work, the content you believe is infringing and where it appears, your contact information, and a statement that you have a good faith belief the use is not authorized. We will review and respond promptly.

9. Disclaimer of warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error free, or free of harmful components.

10. Limitation of liability

To the fullest extent permitted by law, CNB Creative and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of or inability to use the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). This section does not limit liability under any separate written agreement for services.

11. Indemnification

You agree to defend, indemnify, and hold harmless CNB Creative and its owners, employees, and contractors from any claims, damages, losses, and expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

12. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction of those courts.

13. Changes to the Site and these Terms

We may update, suspend, or discontinue any part of the Site at any time. We may also revise these Terms by updating the effective date at the top of this page. Your continued use of the Site after a change means you accept the revised Terms.

14. General

If any provision of these Terms is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us about the Site.
